1. Scope and Subject Matter

These Terms of Use govern the contractual relationship between the operator of the FachNetz platform (hereinafter "Operator") and users who utilize the platform's services. The platform serves to mediate and network skilled workers, service providers, and clients in the craft sector.

By registering and using the platform, the user agrees to these terms. Any conflicting or deviating general terms and conditions of the user shall not be recognized unless the operator expressly agrees to their applicability in writing.

2. Service Description and Liability

The operator provides a digital platform on which users can create profiles, publish projects, and contact each other. The operator assumes no warranty for the accuracy, completeness, or timeliness of content posted by users.

• The mediation of skilled workers is based on the qualifications specified by the users themselves. The operator does not verify this information.
• The operator is only liable for damages caused by intentional or grossly negligent behavior of the operator or its vicarious agents.
• For slight negligence, the operator is only liable in the event of a breach of essential contractual obligations (cardinal obligations), limited to the typical, foreseeable damage.

Liability for data loss, lost profits, or damages from third-party claims is excluded to the extent permitted by law.

3. User Obligations

Each user undertakes to provide truthful and complete information during registration and use of the platform. Using the platform for illegal or immoral purposes is prohibited.

• It is forbidden to create profiles with false identities or without proper authorization.
• Publishing content that violates applicable law or infringes on the rights of third parties is not permitted.
• Users may not use automated systems (bots, crawlers) to access the platform or extract data.

The operator reserves the right to block access to the platform or delete the user account in the event of violations of these obligations.

4. Rights to Content and Data Protection

The user grants the operator the non-exclusive right, limited to the duration of use, to store, publish, and process the content they have posted on the platform. The user retains all rights to their content.

The processing of personal data is carried out in accordance with the privacy policy, which is available at policy.html. The operator undertakes to comply with applicable data protection regulations.

4.1. Use of Contact Data

Contact data published on the platform (email address, telephone number) may only be used for project communication purposes within the platform. Passing it on to third parties or using it for advertising purposes is prohibited.

5. Termination and Cessation of Use

Use of the platform can be terminated at any time without stating reasons. The user can delete their account via the profile settings. The operator can terminate use without notice for good cause, particularly in the event of violations of these terms or suspicion of fraudulent activities.

Upon termination of use, the user's personal data will be deleted, unless statutory retention obligations apply. Content already published may remain on the platform in anonymized form.

6. Changes to the Terms of Use

The operator reserves the right to change these Terms of Use at any time with effect for the future. Users will be informed of significant changes by email or via a notice on the platform. If the user does not object to the changed terms within four weeks of receiving the notification, the changes are deemed accepted.

The operator will inform the user of the objection period and the legal consequences in the change notification. In the event of a timely objection, the usage relationship will continue under the previous terms, unless the operator rejects this.
